Simplification of Laws

  • Ease of Hiring and Firing: The Industrial Relations Code allows firms with up to 300 workers to lay off employees without government approval, promoting flexibility and attracting investment.
  • Fixed-Term Employment: The new provisions encourage hiring through fixed- term contracts, providing companies with flexibility while ensuring workers’ benefits.

Improved Social Security

  • Wider Coverage: The Code on Social Security expands social security benefits like provident fund, insurance, and maternity benefits to gig and platform workers.

Demerits of the Four Labor Codes

  • Lack of Infrastructure: Poor digital and institutional infrastructure may hinder the effective implementation of social security provisions for informal workers.

  • Lack of Protections for Informal Workers: Although the codes promise social security to informal and gig workers, implementation mechanisms remain unclear, leaving many without real protections.
  • Weakened Labor Unions: The Industrial Relations Code restricts the right to strike, making it harder for unions to organize and bargain collectively, raising concerns about worker exploitation.

Exclusion of Smaller Enterprises

Threshold Exemptions: Many small firms employing less than 10 workers are exempt from several provisions, potentially excluding a significant portion of the labor force from protections like minimum wage and safety standards.

Concerns Over Job Security

Increased Precarity: The ease of hiring and firing may lead to job insecurity, particularly for fixed-term contract workers, raising concerns over the erosion of permanent employment opportunities.

Progress So Far
  • Legislative Progress: All four codes have been passed by Parliament between 2019 and 2020. However, implementation has been delayed due to the need for further consultation with states and stakeholders.
