The matter will be heard by a three-judges bench to be headed by Chief Justice of India (CJI) DY Chandrachud. In the joint plea, the Opposition Parties have asked for directions to agencies to comply with the guidelines for arrest and bail proceedings.

“I am asking for the guidelines for the future. This is a remarkable convergence of 14 parties against the misuse of the agencies, both CBI and ED,” said senior advocate Abhishek Singhvi.

He asserted that 95 per cent cases in the hands of Enforcement Directorate (ED) and Central Bureau of India (CBI) are against the Opposition leaders.

He pointed out that the surge in the cases against Opposition leaders was observed after 2014, the year when the Bharatiya Janata Party (BJP) formed government in the Centre.

“Second statistics, pre-2014 and post-2014: there is a humongous jump in cases. The rate of conviction is four to five per cent. We are asking for pre-arrest guidelines and post-arrest bail guidelines,” he added.

The plea further stated that the probe agencies are being used in a targeted manner to completely crush political dissent and upend the fundamental premises of a representative democracy.
