Kerala High Court Bans Use Of AI Tools Like ChatGPT For Judicial Orders, Cites Risk Of Errors And Misuse

The court has clarified that cloud-based AI tools, such as ChatGPT, should not be used to issue orders, and strict action will be taken if these instructions are violated.

The Kerala High Court on Sunday barred courts from using artificial intelligence (AI) tools to issue orders. In this context, special instructions have also been issued to judicial officers and other concerned parties.

The court has clarified that cloud-based AI tools, such as ChatGPT, should not be used to issue orders, and strict action will be taken if these instructions are violated. Apart from this, it has also been said that AI should not be used to give judgments or orders or to reach any conclusion.

The High Court has emphasized on caution in view of the possibility of mistakes in the use of AI tools. For this, it is necessary to take appropriate training, which can be obtained through training programs organized by the Judicial Academy or the High Court.

If AI tools are used, they should only be approved tools and monitoring should be ensured at every stage. Also, if any malfunction or problem is found in the approved AI tools, it is mandatory to inform the IT Department of the High Court.

This is the first time a High Court has issued such an order. Earlier on July 16, the Kerala High Court had quashed the driving license exam reforms implemented by the State Transport Commissioner. This decision came after a petition filed by driving schools, which described the new rules as irrational, one-sided and restricting vehicles. The driving school operators argued that these rules are an interference in the jurisdiction of the Central Government. Accepting this argument, the High Court quashed the circular and related orders of the Transport Commissioner.

The Kerala government can appeal against this decision in the division bench. The driving license exam reform included increasing the number of examinations to 30 per day and building a new track in place of ‘H Test’. Also, the use of vehicles older than 15 years and vehicles with foot gear in the two-wheeler license exam was banned. Apart from this, the use of automatic vehicles and electric cars was also banned for the car license exam.
